Gentlemen:
We hereby open our Irrevocable letter of credit in your favor account of XYZ Company, xxxxx for a sum of sums not exceeding a total of us $ 200,000. - available by your draft(s) drawn at sight on us for 100% of invoice cost, and accompanied by the following documents evidencing shipment(s) of 200 M/Tons of Crude Sugar
from xxx xxx to xxxx, xxxx
Full set of clean no board ocean bills of lading made out to the order of xxxxx First Bank, xxxxx marked "Freight Collect" and "Notify XYZ Company, xxxxx"
Signed commercial invoice in quintuplicate
Packing list in triplicate
Consular invoice and certificate of origin in duplicate issued or visaed by xxxxx Consular in xxxxxxxx Partial shipments are Permitted Transhipment is prohibited.
Shipment must be effected on or before April 30, 1993
All drafts hereunder must be marked "Drawn under xxxxx First Bank, xxxxx, Credit No. 0123 dated February 1, 1986 and all other documents shall also contain the reference number of this credit."
The amount and date of negotiation of each draft must be endorsed on the reverse hereof by the negotiation bank.
Unless otherwise expressly stated, this credit is subject to " Uniform Customs and Practice for Documentary Credits (1992 Revision), International Chamber of Commerce, Publication No. 500."
We hereby agree with the drawers, endorsers, and bona fide holders of drafts of drawn under and in compliance with the terms of this credit that the same shall be duly honored on due presentation and on delivery of documents as specified.
This Letter of Credit shall not be available unless and until standard prime banker's irrevocable Letter(s) of Credit in favor of XYZ Company, xxxx for account of ABC Company, XXXXXX for an aggregate account of US $ 200,000. - have been established pursuant to contrast No. 1005 for the export of 20M/Tons of aluminium coil from xxxxx to xxxxxxxx.
The export Letter(s) of Credit shall be mentioned effective until and not later than February 20, 1993 referring to Compensation Transaction Approval No. 2500 dated December 25, 1992 and shall be available against sight drafts accompanied by the usual commercial documents.
This Letter of Credit shall not be available, if beneficiary's Letter of Credit (for export) are established through banks other than those opening and advising this credit.
